Our total liability to the User under this Agreement, if any, will be limited in all circumstances to the sums paid to us by the User in respect to the services to which the claim relates.
You agree to defend, indemnify and hold harmless the Company, its associated companies and entities, its suppliers and their respective officers, and agents and/or any other third party associated with or in the employ of the Company or such other Person from and against all claims and expenses, including legal fees, arising out of your use of the Site and our services.
The Site includes functions that enable contributors to add and amend property details and attributes to the content on the Site. You hereby grant to the Company an irrevocable, perpetual, non-exclusive, transferable royalty free worldwide licence and right to use, copy, display, reformat, amend, change, excerpt, distribute or sub-license for profit or otherwise in public any such content you add to the site and any amendments you make to existing content, both for the purposes of the Site and any other purpose envisaged or proposed by the Company or its assignees or to retain and use this content for such purposes as the Company sees fit from time to time. You warrant that You are the originator of this content and have the right to grant this licence, or in the alternative that You have obtained in writing all necessary rights, consents and licences from the owners, lessors or licensee of any content you add to the site. You shall fully indemnify and keep indemnified the Company on demand against any and all loss, damages, costs, expenses or other claims arising from any breach of these warranties and licences.
Property details displayed on Mouseprice.com
Mouseprice.com does not display listings directly from consumers. If you are the owner of a property being displayed for sale or for rent on our website this is because the agent you has chosen to use for the sale or the letting of your property has chosen to advertise your property in the public domain.
Details held by us about a property do not comprise personal data as defined by the Data Protection Act 1998. Landmark Analytics may use the data which we hold about properties advertised to provide professional valuation services and other data services to third parties.
Website security & card payments
We take payment security very seriously, which is why we’ve chosen to use credit and debit card processing facilities provided by Sage Pay, one of the world’s leading payment solutions providers. Sage Pay have impeccable fraud prevention capabilities and are master merchants for Visa and MasterCard. The Sage Pay network uses full 128-bit encryption. It is regularly inspected by the major banks to ensure that system integrity and security are maintained to the highest standards. The Sage Pay processing centre is securely linked to many processing banks worldwide, who handle the card authorisations online and process the transactions in real time.

When you register with Mouseprice, set up an alert, enter a competition or buy a product or service, we ask for personal information such as your name, contact details and other details relevant to the products and services you have expressed an interest in. Once you register with Mouseprice and accept our Terms and Conditions, you are not anonymous to us. We may use information that you provide to alert you to our own products and services. We may contact you regarding site changes or changes to the Mouseprice products or services that you use.
The information we collect when you buy from us:
When you place an order with us, we will take your name, e-mail address, and billing address. As well as this information, we’ll also keep records of any further emails you send us, which we will use to help improve the mouseprice service.
Privacy & disclosure of this information:
The information gathered may be used by Mouseprice and companies in the same group, for purposes relating to your use of the sites and the interactive services and property related marketing activities. You consent to receiving unsolicited marketing email for related goods and services from third parties and for us to share your search preferences with them unless opted out on the account settings page. If you do not wish to receive property related emails from Mouseprice notify us by using the unsubscribe link in emails or delete the Area monitor/Track a property alerts from the accounts settings page.
Mouseprice and third-party vendors, including Google, use first-party cookies (such as the Google Analytics cookie) and third-party cookies (such as the DoubleClick cookie) together to report how your ad impressions, other uses of ad services and interactions with these ad impressions and ad services are related to visits to the site. Demographic and Interest Reporting may be used to target ads and analyse site usage.

We do not retain records of payment card information.

It is your sole responsibility to control the dissemination and use of the username and password;
The User is not allowed to assign, dispose of, transfer or sub-contract their rights and obligations as laid out in this Agreement, without Landmark Analytics’ written consent.
As part of our commitment to customer satisfaction we offer a full 90 day refund for any purchase of our automated valuation reports. We are confident in the quality of our statistcal products, however if for any reason you are not satisfied with your purchase please let us know. If you have not received a copy of your report or if you would like a refund you can contact us at
email@example.com. We normally respond to all queries within one working day. Refunds for all our other products and services will remain entirely at the discretion of Landmark Analytics management.
We agree to take payment from you by credit card for all sums due under these terms and conditions. In consideration of this you agree that payment shall be made in full, without cancellation, deduction or withholding whatsoever.
Neither party shall be in breach of the Terms for failure to perform or delay in performing any or all of its obligations as a result of an event of force majeure (“Event of Force Majeure”). For the purposes of the Terms, Event of Force Majeure shall include without limitation acts of God (including flood, fire, earthquake or other similar event), riots, war, strikes, lock-outs or other industrial disputes, epidemics, failure of telecommunication systems, failure of the world wide web, governmental restraints and act(s) of legislature or any cause (other than lack of funds) outside the reasonable control of the affected party. Neither party shall have any liability to the other in respect of the termination of the Terms as a result of an Event of Force Majeure.
These services shall be deemed to have been provided in England and Wales and shall be subject to the laws of England and Wales. The parties agree to submit to the jurisdiction of the courts of England and Wales. These Terms and Conditions, constitute the entire understanding between us as to the subject matter hereof, and supersede any and all prior agreements and understandings.
